Under the assumption that the quote is accurate of what was upheld, then it should not matter to video game sales. (But does apply to DLC and downloaded-only stuff since you're getting it direct in those cases.)

Gamers are not the customers of the game producers. The wholesalers and retailers are. So basically using this ruling software companies can forbid wholesalers and retailers from reselling the games. IE: Prevent them from selling the game to actual gamers. And that solves the publishers problems right?

From what I read the companies can't try to impose no-resale conditions on the customers of their customers. (ie: the customers of the wholesalers and retailers - us) Attempts to do that in the past helped create the first sale doctrine in the first place.

But lobbyists have deep pockets so this bit of common sense is kind of pointless.
